Possible Sentences for a Third DUI in Pennsylvania

A third or subsequent DUI involving a blood alcohol concentration (BAC) of .08% to .099% is considered a Misdemeanor of the Second Degree. Under Pennsylvania law, the courts can impose the following penalties:

  • A 12 month driver’s license suspension;
  • Between 10 days and two years imprisonment;
  • Installation of an ignition interlock device for one year;
  • Payment of fines between $500 and $5,000;
  • Successful completion of the alcohol highway safety school; and
  • Completion of any court-ordered alcohol or drug abuse treatment.

A driver charged with a third DUI having a BAC of .10% to .159% can face a Misdemeanor of the First Degree if convicted. Under Pennsylvania law, the court can impose the following sentence:

  • Installation of an interlock device for up to one year;
  • An 18 month driver's license suspension;
  • Between 90 days and five years imprisonment;
  • Fines between $1,500 and $10,000;
  • Successful completion of an alcohol highway safety school; and
  • Completion of alcohol or drug abuse treatment, if ordered.

A driver charged with a third or subsequent DUI involving a BAC of .16% and higher can also face a conviction of a Misdemeanor of the First Degree. Under Pennsylvania law, this type of conviction can result in the following punishments:

  • At least one year in prison;
  • Installation of the ignition interlock for one year;
  • An 18 month driver's license suspension;
  • Payment of at least a $2,500 fine; and
  • Completion of an alcohol or drug treatment program, if ordered.

Possible Penalties for a Fourth DUI in West Chester

A fourth or subsequent DUI involving a BAC of .10 to .159% is also considered a Misdemeanor of the First Degree. Under Pennsylvania law, if the driver is convicted of a fourth or subsequent DUI for this BAC range, the courts will usually impose the following sentences:

  • Ignition interlock installation for one year;
  • An 18 month driver's license suspension;
  • Sentence of one to five years in prison;
  • Fines between $1,500 and $10,000;
  • Successful completion of the alcohol highway safety school; and
  • Completion of alcohol or drug abuse treatment, if ordered.
