KIDNAPPING

KIDNAPPING

No matter where you reside, a kidnapping charge has the potential to come with extremely harsh consequences, and Pennsylvania is no exception. With all the possible life altering consequences that come with a kidnapping conviction, approaching the situation as a defendant in the proper manner is very important.

In some cases, a kidnapping charge is quite difficult to defend. In others, many factors may be involved that give you a good opportunity to argue your case and prove that you were not at fault. Considering that a kidnapping charge can become very complicated or based off of a bogus allegation, having a qualified criminal defense attorney at your side is vital.

Kidnapping under Pennsylvania Law

Pa. Cons. §2901 defines kidnapping under Pennsylvania law, and states that a person is guilty of kidnapping if he unlawfully removes another substantial distance under the circumstances from the place where he is found, or if he unlawfully confines another for a substantial period in a place of isolation, with any of the following intentions:

  • To hold for ransom or reward or as a shield or hostage.
  • To facilitate commission of any felony or flight hereafter.
  • To inflict bodily injury on or to terrorize the victim of another.
  • To interfere with the performance of any governmental or political function.

A kidnapping allegation will be charged as a felony of the fist degree, which comes with a presumptive sentence of up to twenty years in prison and/or a fine of up to $25,000.
