Simple Assault under Pennsylvania Law

According to Pa. Const. Stat. §2701, a simple assault offense occurs when:

  • The person attempts to cause, or intentionally, knowingly or recklessly, causes bodily injury to another;
  • The offender negligently causes bodily injury to another with a deadly weapon;
  • The person attempts by physical menace to put another in fear of imminent serious bodily injury;
  • The person conceals or attempts to conceal a hypodermic needle on his person and intentionally or knowingly penetrates a law enforcement officer or an officer or an employee of a correctional institution, county jail or prison, detention facility or mental hospital during the course of an arrest or any search of the person.

Penalties for Simple Assault in Pennsylvania

Pa. Cons. Stat. §2701 states that simple assault is generally classified as a misdemeanor of the second degree. This charge comes with a presumptive sentence of up to two years in prison and / or fines of up to $5,000.

Although a second-degree misdemeanor is the most common charge, there are two circumstances in which the penalty will be different:

  • If the assault happened in a fight or scuffle that was entered into by mutual consent, you will be charged with a misdemeanor of the third degree. This comes with a possible sentence of up to one year in prison and / or fines of up to $2,500.
  • If the assault was against a child under 12 years of age by an adult 21 years of age or older, the charge will be increased to a misdemeanor of the first degree. This comes with a possible sentence of up to five years in prison and / or fines of up to $10,000.
