Sexual Assault under Pennsylvania Law

According to Pa. Cons. Stat. §3124.1, a person commits a felony of the second degree when that person engages in sexual intercourse or deviate sexual intercourse with a complainant with the complainant’s consent.

A felony of the second degree comes with a presumptive sentence of up to 10 years in prison and/or fines of up to $25,000.

Statutory and Institutional Sexual Assault

Pa. Cons. Stat. §3122.1 states that a person is guilty of statutory sexual assault if that person engages in sexual intercourse with a complainant under the age of 16 years and that person is four or more years older than the complainant and they are not married to each other.

A statutory sexual assault charge is considered a felony of the second degree, which comes with a presumptive sentence of up to 10 years in prison and/or fines of up to $25,000.

According to Pa. Cons. Stat. §3124.2, a person who engages in sexual intercourse, deviate sexual intercourse or indecent contact with an inmate, detainee, patient or resident, is guilty of institutional sexual assault if that person is an employee or agent of a:

  • Department of Corrections or a county correctional authority,
  • youth development center,
  • youth forestry camp,
  • State or county juvenile facility,
  • Other licensed residential facility serving children and youth, or
  • Mental health or mental retardation facility or institution.

Institutional sexual assault is considered a felony of the third degree, which comes with a presumptive sentence of up to 7 years in prison and/or up to $15,000 in fines.
