Pennsylvania's Interstate Compact for Adult Offender Supervision (ICAOS)

Effective June 19, 2002, Pennsylvania's legislature enacted 61 Pa. C.S.A. ยง 7112, which authorizes the Commonwealth of Pennsylvania to join the Interstate Compact for the Supervision of Adult Offenders (ICAOS). When an individual is placed on probation or parole in one state but wants to move to another state to serve out the conditions of probation or parole, the other state must agree to supervise the individual on probation or parole. The process of transferring probation or parole supervision from one state to another is governed by the Interstate Compact for Adult Offender Supervision (ICAOS). The interstate compact is an agreement reached by each of the 50 states, the District of Columbia (DC), Puerto Rico and the U.S. Virgin Islands.

Many problems arise under the ICAOS. As a preliminary matter, the person placed on probation must often wait a lengthy period of time while the application is being considered. In many cases, this presents a hardship for the individual to stay in Pennsylvania while waiting for the other state to approve the interstate compact transfer of probation.

Violation of Probation in Interstate Compact Cases

Other problems arise when an individual allegedly violates probation after the probation has been transferred to another state. The probation officer that supervises the offender must then report that information to the probation officer in the jurisdiction where the offender was originally sentenced. That probation officer will forward the information to the court. If the court signs a violation of probation warrant for the offender's arrest, the warrant can be a warrant with a bond or a no bond warrant.

Pennsylvania State Fees for Interstate Compact
